Silver has it on the nose. As the "code" owned by Blizzard contains the Gold, and since you lease time to use their code on their servers, AND since there cannot be an exact monetary amount placed upon WoW gold, it is nontaxable. The writing of tax law for that would be retarded. Not to mention, depending on what state you live in, you could be taxed differently for the amount of gold you have. But as always, there will be ways around audits and stuff of that nature. fradulant accounts can be created and paid for in game time, and they can be pools for the gold. There are so many ways to get around it, as there is any tax law.

Upon further research, Actually, according to the US Tax Code, Intellectual Property can not be taxed (for now). As the gold is "Code" property of Blizzard, Inc, if the legislature decided to tax said intellectual property, then Blizzard, Inc, being sole owner of the code, would be responsible to pay taxes on the gold they are leasing the use of through their monthly fee. I dont think they'd go for that.
